Permit rules

In accordance with the provisions of the Northwest Territories Motor Vehicles Act and the large vehicle control regulations, the carrier is hereby exempted from section 30 subject to the following conditions:
  1. The axle lift device may be activated only when the trailer is empty and be designed such that it can maintain an axle in the up position.
  2. When the trailer is partly or fully loaded, all axles shall be on the ground.
  3. The device must have a single on/off switch. When the switch is in the "on" position, the axle(s) are raised from contact with the ground. When the switch is in the "off" position, all of the axles must be on the ground and the suspension must be fully operational. Variable switching mechanisms cannot be installed or used.
  4. When the axles are in contact with the ground, the axle group shall conform to either a tandem or tridem axle, in accordance with the large vehicle control  regulations.
  5. When the axle lift device is activated, the trailer wheelbase must conform to legal dimensions. The device may be installed only on legal tandem and tridem axles of a trailer. The device shall not be installed on a truck or truck tractor unit.
  6. The carrier of the vehicle shall not modify the device. The device shall be equipped with tamperproof features to prevent any adjustment, except by the  manufacturer or by an authorized agent of the manufacturer.
  7. A system status light shall be displayed at a location such that it is visible to the driver, to indicate when the axle lift device is activated. This light must conform to section 41 of the Motor Vehicle Equipment Regulations made under the Motor Vehicles Act.
  8. When the device is installed on a trailer, the trailer must remain in compliance with the requirements of the Transport Canada Motor Vehicle Safety Act.
  9. All other requirements of the regulations under the Motor Vehicle Act  shall apply.
  10. Every driver of a vehicle being operated in accordance with this permit shall carry a copy in the vehicle and shall produce such permit upon the request of a  motor vehicle officer.
